Plain-English summary. We collect the minimum personal information needed to help you buy or sell a home, we do not sell it, we do not use it to train AI models, and you can ask us to delete it at any time. If a policy section is unclear, email us and we will walk you through it.

1. Who We Are

This policy describes how Raquel Rojas Moran, a licensed real-estate professional operating in Illinois, collects and uses your personal information.

Raquel operates under Baird & Warner's brokerage license. Some records described below are held jointly by Raquel and the brokerage as required by Illinois law.

2. Scope

This policy covers personal information collected through:

  • Raquel's website and landing pages
  • Meta (Facebook/Instagram) lead forms
  • Phone calls and SMS text messages, including messages handled by the “Sofia” AI assistant (see Section 5)
  • Open houses, showings, and in-person meetings
  • Referrals from past clients or partners
  • Transaction paperwork handled through Baird & Warner

It does not cover third-party sites linked from Raquel's pages (MLS portals, mortgage lenders, title companies, etc.), which publish their own policies.

3. What We Collect

  • Identity: first and last name
  • Contact: mobile phone number, email, mailing address
  • Property preferences: budget, bedrooms, neighborhoods, timeline, buy/sell/rent intent
  • Financial readiness (where you volunteer it): pre-approval status, cash-on-hand range, whether you need to sell first
  • Lead source: which ad, form, or referral brought you in
  • Conversation history: your text messages with Sofia and with Raquel, call summaries
  • Transaction records (if you become a client): listing agreements, buyer representation agreements, disclosures, offers, and closing documents held by the brokerage
  • Website analytics: IP address, device, referring URL, pages viewed

Illinois-specific notices:

  • We do not collect, capture, purchase, receive through trade, or otherwise obtain biometric identifiers or biometric information (voiceprints, faceprints, fingerprints) — the Illinois Biometric Information Privacy Act (BIPA, 740 ILCS 14/) does not apply to our operations. If that ever changes, this policy will be updated with a specific BIPA consent flow.
  • We do not collect genetic information — the Illinois Genetic Information Privacy Act (GIPA, 410 ILCS 513/) does not apply.
  • In the event of a breach of unencrypted personal information, we will notify affected Illinois residents within the time required by the Illinois Personal Information Protection Act (PIPA, 815 ILCS 530/).

4. Why We Collect It (Purpose & Legal Basis)

  • To respond to your inquiry and book showings or listing appointments
  • To match you with properties and send relevant listings
  • To comply with Illinois real-estate law, including agency disclosure, recordkeeping, and anti-fraud obligations under 225 ILCS 454/
  • To comply with federal SMS rules — specifically the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, which requires prior express written consent before we send marketing texts using automated or AI-generated systems
  • To comply with anti-money-laundering rules, including FinCEN Geographic Targeting Orders (GTOs) that cover certain Chicago-area high-value residential transactions, and to file Suspicious Activity Reports (SARs) where required

5. AI Assistant and Automated Decisions

Some replies you receive through this website, SMS, or Meta lead forms are generated by Sofia, an AI assistant operated on Raquel's behalf by her technology service provider.

  • Sofia handles first contact, qualifying questions, and scheduling. She does not make legally binding decisions about you, and she does not approve, deny, price, or close real-estate transactions.
  • A human (Raquel or a licensed teammate) is always available on request. Ask for “a human” or “Raquel” and you will be handed off.
  • Sofia does not give legal, tax, lending, appraisal, or inspection advice. All representation agreements, offers, and closing documents are reviewed and signed with Raquel and Baird & Warner.
  • Your conversations are logged for quality, training our team, and brokerage recordkeeping. We do not use your personal information to train third-party AI models.
  • Where you are located in a jurisdiction that provides a right to meaningful information about automated decision-making (such as Colorado, the EU, or the UK), you may request a summary of how Sofia handled your inquiry by contacting the privacy email below.

6. TCPA Consent for SMS

By providing your mobile number to Raquel Rojas Moran — through a website form, Meta lead form, or directly — you agree to receive autodialed and AI-generated text messages from Raquel and her AI assistant Sofia at that number, including messages about property matches, showings, and follow-up. Consent is not a condition of any purchase or service. Message and data rates may apply. Message frequency varies. Reply STOP to cancel at any time, or HELP for help.

Records of your consent, the time it was given, and the source (which form or page) are kept as long as TCPA litigation exposure is active — generally at least 5 years.

7. Categories of Service Providers

We share personal information only with categories of vendors who need it to operate the business:

  • Our technology and AI platform partner— Raquel's CRM, Sofia AI assistant, and lead management
  • Telecommunications providers — SMS and voice delivery
  • Artificial intelligence model providers — large-language-model processing that powers Sofia
  • Cloud infrastructure providers — hosting, database, and file storage
  • Productivity software providers — email, calendar, and scheduling
  • Advertising and analytics platforms — lead generation, retargeting, and website analytics
  • Our brokerage, Baird & Warner — transaction paperwork and compliance (required by Illinois law)
  • Electronic signature providers — where used for agreements

Each provider is bound by contract to use your data only for the services they provide to us, and only in ways consistent with this policy.

8. Cross-Border Transfer

Our technology service provider operates from Canada, and several of our vendors operate from the United States and other jurisdictions with global infrastructure. Your personal information may be processed in any of these locations.

Where international data transfers occur, we rely on the legal mechanisms recognized in the destination jurisdiction — including the EU-US Data Privacy Framework (where applicable), Standard Contractual Clauses, and contractual safeguards with each vendor — to protect your information regardless of where it is processed.

9. How Long We Keep It

Concrete retention periods per data category. Shorter than any window below where the purpose has been fulfilled earlier and no legal obligation requires continued storage.

10. Your Rights

  • Opt out of SMS at any time — reply STOP to any text, email raquel.moran@bairdwarner.com, or use the contact form
  • Request a copy or correction of the personal information we hold about you — email the address above
  • Illinois Personal Information Protection Act (PIPA), 815 ILCS 530/ — governs how we secure your information and notify you of breaches
  • California residents— if you reside in California, the CCPA/CPRA gives you the right to know, delete, correct, and opt out of “sale” or “sharing” of personal information. We do not sell personal information. To exercise these rights, email the address above.

11. How to Opt Out

  1. Text STOP to any message from Raquel or Sofia. The system stops immediately and logs the opt-out.
  2. Email raquel.moran@bairdwarner.com with “Opt out” in the subject line.
  3. Website contact form— select “Remove me from contact.”

Opting out of marketing SMS does not remove transactional messages required to complete a deal you are actively in (e.g., closing reminders).

12. Data Breach Notification

If a breach of unencrypted personal information occurs, we will notify affected Illinois residents in the most expedient time possible and without unreasonable delay, as required by the Illinois Personal Information Protection Act, 815 ILCS 530/10. Notice will describe the incident, the types of information involved, and the steps you can take.

13. Illinois Brokerage Disclosures

Under the Illinois Real Estate License Act of 2000, 225 ILCS 454/15-25 through 454/15-50:

  • Raquel works as a designated agentunder Baird & Warner's sponsoring broker license.
  • Before she represents you in a specific transaction, she will present a written agency disclosure explaining whether she represents the buyer, the seller, or, with written consent, both parties as a dual agent.
  • Commission amounts and who pays them are disclosed in writing in the representation agreement, consistent with IDFPR rules and the post-2024 NAR settlement changes.
  • Raquel does not provide legal, tax, appraisal, inspection, or lending advice. She will refer you to licensed professionals for those services.

15. Changes to This Policy

We review this policy at least once a year and whenever we add or change a service. The “Effective date” and “Version” at the top of this page show the latest revision. Material changes will be announced on the homepage for at least 30 days before taking effect.
